Thank you for using our services (“Services”). Services and Goods are provided by Elements of Speech registered in Golden, Colorado. Your initialization of services either by voice confirmation via telephone, email, or text, is considered an agreement to these terms. Please read these Terms carefully before scheduling services or accepting a quote (“Quote”) provided by Elements of Speech L.L.C,

 

Terminology

(“you”, “your”, “user”, “client”, “his”, “him”, “their” “her” or “customer”) client contracting for services to be provided by Elements of Speech L.L.C

(“us”,  “we”, “our”, “our company” or “ourselves”,   “EOS”) Elements of Speech L.L.C and any of its agents.

(“Party”, “Parties”, or “Us”) refers to both the Customer and Ourselves, or either the customer or ourselves.
(“Terms”,    “Terms and Conditions”) These Terms and Conditions constitute an agreement between you and Elements of Speech L.L.C

(“goods”, “orders”, “services”) means a request by You to purchase labor from Us as deliverables in the form of digital or tangible materials.

Quote

Project quotes serve as estimates only, as an approximation and are not guarantees of final invoice amount. The quoted price is based on information provided from the client regarding project requirements. Actual cost may change once all project elements are finalized or negotiated.
 

Deposit

A deposit of 50% of the quoted rate for your full service is due upon acceptance of a Quote when services exceed USD $99.00. The quoted price will be issued through email or text communication between you and an agent acting on behalf of EOS. Once quoted rates for services have been agreed upon by both parties, the client will furnish EOS with payment. The payment of the deposit or acceptance of the quote indicates agreement for the quoted rate.

 

Refunds and Cancellations

The deadline for cancelling an Order is 2 business days from the date on which You accepted the quote.

In order to exercise Your right of cancellation, You must inform Us of your decision by means of a clear statement. You can inform us of your decision by:

If a deposit has been paid, We will reimburse You no later than 14 business days from the date on which We receive the notice of cancellation. We will use the same means of payment as You used for the Order, and You will not incur any fees for such reimbursement.
 

Conditions for Refunds

In order for the Goods to be eligible for a refund, please make sure that:

• The Goods/services were purchased in the last 7 days

Goods cannot be refunded if:

• Goods were made to Your specifications or clearly personalized.

• Goods include Digital content

• The date of expiry is over (7 days).

• The supply of Goods has been shipped.
   

We reserve the right to refuse refunds of any merchandise that does not meet the above conditions in our sole discretion.

Only regular priced Goods may be refunded. Unfortunately, Goods on sale cannot be refunded. This exclusion may not apply to You if it is not permitted by applicable law.

Shipment of Goods

We cannot be held responsible for Goods damaged or lost in shipment. Therefore, We recommend an insured and trackable mail service.

 

Payment Policy

A deposit of 50% for services quoted over USD $99.00. After services have been completed, the total charges and any necessary fees and taxes will be calculated and invoiced. Payment of invoice for the balance of services rendered is due 15 (fifteen) days from the invoice date.

Service Fee Policy
The purpose of this policy is to outline the service fee that will be charged by EOS for providing administrative support services. The service fee will be calculated based on the total billable hours per customer invoice total in a given billing cycle. This fee pays for services related to the primary product or service being purchased. Any additional billable hours for work performed on ancillary products or services will be billed at our standard hourly rate. This fee will be incurred by the customer on a per invoice or at such other interval as deemed appropriate by EOS, within a billing cycle. The rate will not exceed 0.25% on a bi-monthly or per project basis of the average charge per invoice. Service fees are non-refundable.

 

Privacy Policy

Elements of Speech uses best practices to safeguard your personal data and information. Data collected can include (but is not limited to): name, address, employer, billing information, and email. Elements of Speech will not sell or share your information unless ordered to by law, however, we reserve the right to keep a record of your information as part of our business operation practices. We use the highest standards to protect your information. However, should there be a breach of our system, either party’s financial institution, or internet service provider, we are not liable for any personal information that you submit to us. All the information provided is done so at will and at your own risk.

 

Photo and Video Release

You hereby understand and authorize Elements of Speech to use or cause to be used still photographs or motion/voice recordings for advertising, publicity, commercial, or other business purposes. Photographs or videos may be edited at the discretion of Elements of Speech in order to suit the format, length, or aesthetic need for business use.

 

Services

You understand that Elements of Speech provides electronically created services including proofreading, editing, authoring original content, and design services. It shall be your own responsibility to ensure that any deliverables (including but not limited to employees’ names, contact information, technology, and brand and industry specific terminology) are correct and true, to then be used by our company and are formatted in the required file type that is necessary for your end use.

The information contained on the Service is for general information purposes only.

The Company assumes no responsibility for errors or omissions in the contents of the Service.

In no event shall the Company be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice.
